Welcome to Elite AU Peptides. These Terms of Service (“Terms”), together with any policies referenced in them, describe your rights and responsibilities when you use our website and store (the “Services”). They include important information about warranty disclaimers and limitations of liability, so please read them carefully. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services.
1. Access and account
By agreeing to these Terms, you represent that you are at least 18 years old and the age of majority in your state or territory of residence. To use the Services — including browsing our store or purchasing products — you may be asked to provide certain information, such as your email address and billing, payment, and shipping details. You represent that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it. 2. Our products
We have made every effort to represent our products accurately. However, colours and product appearance may differ from how they appear on your screen due to your device and its settings. We do not warrant that the appearance or quality of any product will meet your expectations or match how it is depicted. All product descriptions are subject to change at any time without notice, and we may discontinue any product or limit the quantities we offer to any person, region, or jurisdiction.
3. Research use only
All products offered through the Services are supplied strictly for in-vitro / laboratory research use only. They are not therapeutic goods, are not TGA-approved, and are not intended for human or animal consumption. Nothing on the Services constitutes medical advice or a therapeutic claim, and no product is intended to diagnose, treat, cure, or prevent any disease or condition.
By placing an order, you represent and warrant that:
- you are at least 18 years of age;
- you are acquiring the products for legitimate research purposes only;
- you are legally permitted to purchase, possess, and handle the products in your jurisdiction; and
- you accept full and sole responsibility, and all liability, for the handling, storage, testing, and use of anything you purchase, and you will comply with all applicable laws and regulations.
4. Orders
When you place an order, you are making an offer to purchase. Elite AU Peptides may accept or decline your order for any reason at its discretion, and your order is not accepted until we confirm acceptance; we must receive and process your payment before an order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, change, or cancel an order, we will attempt to notify you using the contact details you provided. Your purchases are subject to return or exchange solely in accordance with our Refund Policy. You represent that your purchases are for your own research use and not for commercial resale.
5. Prices and billing
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect when the order is placed, as set out in your order-confirmation email. Unless otherwise stated, posted prices do not include taxes, shipping, handling, or any customs or import charges. Promotions may be governed by separate terms, which will govern in the event of a conflict. You agree to provide current, complete, and accurate purchase and payment information, and you represent that you are authorised to use the payment method you provide and will pay all charges incurred at the posted prices.
Prices are displayed in Australian dollars (AUD). Payment may be processed in US dollars (USD); your card issuer's exchange rate and any associated fees will apply.
6. Shipping and delivery
All delivery times are estimates only and are not guaranteed. We are not liable for shipping or delivery delays, including those caused by carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you. Shipping is covered in more detail in our Shipping Policy.
7. Intellectual property
The Services — including all trademarks, brands, text, displays, images, graphics, and the design, selection, and arrangement of them — are owned by Elite AU Peptides or its licensors and are protected by Australian and foreign intellectual-property laws. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material on the Services without our prior written consent. Elite AU Peptides' names, logos, and designs are our trademarks and may not be used without our prior written permission. All rights not expressly granted are reserved.
8. Optional tools
You may be given access to third-party tools that we neither monitor nor control. We provide access to such tools “as is” and “as available” without any warranties and without endorsement, and we have no liability arising from your use of optional third-party tools. Any use is entirely at your own risk, and you should review the relevant third party's terms.
9. Third-party links
The Services may contain links to websites operated by third parties. We are not responsible for examining or evaluating their content or accuracy and are not liable for any harm related to your use of third-party websites or your purchase or use of any products or services from them. Please review the third party's policies carefully before engaging in any transaction.
10. Platform and service providers
Our Services rely on third-party providers for hosting, commerce, and payment processing. Any sale or purchase you make through the Services is made directly with Elite AU Peptides. You acknowledge that our providers are not responsible for any aspect of a sale between you and us, including any injury, damage, or loss resulting from purchased products, and you release them from claims arising from your purchases and transactions with us.

All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read it.
12. Feedback
If you submit any ideas, suggestions, feedback, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display that Feedback for any purpose, including commercial use. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it, and we may remove Feedback we consider unlawful or objectionable.

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any errors and to change or update information, or cancel orders, if any information is inaccurate at any time without prior notice, including after you have submitted your order.

We may terminate this agreement or your access to the Services at our discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Sections that by their nature should survive termination — including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, and Governing Law — will continue to apply.

The information presented on or through the Services is provided for general information purposes only. We do not warrant its accuracy, completeness, or usefulness, and any reliance you place on it is at your own risk.
EXCEPT AS EXPRESSLY STATED BY ELITE AU PEPTIDES, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. Nothing in these Terms excludes or limits any guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
18. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL ELITE AU PEPTIDES OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, OR CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS — ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED THROUGH THEM, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Where liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.
19. Indemnification
You agree to indemnify, defend, and hold harmless Elite AU Peptides and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable legal fees, arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your access to and use of the Services.
20. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity and enforceability of the remaining provisions.
21. Waiver; entire agreement
Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of that right or provision. These Terms, together with any policies posted on the Services, constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreements between us.
22. Assignment
You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent, and any such attempt will be void. We may assign or transfer these Terms and our rights and obligations without restriction.
23. Governing law
These Terms, and any separate agreements through which we provide you Services, are governed by and construed in accordance with the laws of New South Wales, Australia. You and Elite AU Peptides submit to the non-exclusive jurisdiction of the courts of New South Wales.
24. Changes to these Terms
You can review the most current version of these Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website, and it is your responsibility to check periodically for changes. We will notify you of material changes in accordance with applicable law. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
